    Abstract: 從歐洲社會權發展的脈絡與軌跡來觀察,男女同工同酬;乃至於同值同酬原則,不論在歐洲法之第一級法或第二級法,前者如歐體條約第一四一條,後者如一九七五年的第一一七號工資平等指令,都有清楚的規範烙印。聚焦於德國法秩序,從司法實務發展之一般平等對待原則開始,到民法第六一一a條與第六一二條第三項之納入,最後到一般平等對待法的整合進整體之私法歧視禁止法制,亦可同時觀察到內國制定法基礎的演進過程,再搭配以法釋義學角度的發展,例如同值之概念或基於性別之工資區別,尤能看出同值同酬原則之規範意涵。
