    Title: 台灣保險法關於惡意複保險法律效果之檢討與修正建議

    Abstract: 臺灣學界對於保險法第三七條所稱之「無效」究何所指,向有「第一保險契約有效說」; 「全部無效說」及「分別處理說」之爭,且未見定論。司法實務,則自七十六年台上字第一一六六號判例採「第一保險契約有效說」以降,極鮮見反對見解,至晚近下級法院始偶有不同見解。惟上開三 說仍乏一說全然無瑕,且比較法上,英美法系國家及日本與中國大陸,對複保險皆已不以部區分善意與惡意而一律有效,則惡意複保險除於賦予保險契約「無效」之效果外,於立法論上有否為不同處理之可能,甚值探討。另,保險法第二三條第二項關於違反複保險 通知義務不退還保費之規定,對要保人或被保險 人似屬過苛。本文即試自保險與保險法理論;保 險實務及比較法出發,暫逸脫「無效說」之囹圄,重新建構妥適之惡意複保險法律效果。
