    Abstract: 印鑑章原則上應由本人自行保管使用,委託他人保管使用或被盜蓋為例外,甲以次五人是否應就A非自己用印,實係乙盜蓋之例外事實負舉證責任?又銀行儲蓄存款取款憑條,依法不須由存款戶自己親自填寫,依一般社會經驗由他人代為填寫者比比皆是,況領取銀行活期儲蓄存款,並非以印章為唯一憑證,尚須存款戶之銀行存摺始足領取,故無法僅因由非存款戶自己填寫銀行儲蓄存款憑條,即認向銀行領款者並非存款戶本人領取。乙於上開滙款時,由其以A名義填寫活期存款取款憑條,已為其所自認,該取款憑條上存戶簽章上所蓋A印章復屬真正,是否可認為無法否認A存於該銀行帳戶之七百五十一萬元,非由A親自或委由乙領取?對於乙主張A生前贈與該存款之事,是否應由乙先行舉證?
