Abstract:	合法聽審權係具憲法位階之程序法原則,除少數有具突襲必要之事件類型之外,對於合法聽審權之保障,應視為程序法之法原則之一。對於專利侵權事件,因事件之特殊性,對於其定暫時狀態假處分事件,如何平衡兩造間之利益,即成為問題重點所在。雖實務對合法聽審於專利侵權事件之定位,其效力於定暫時狀態類型之評價,存在不同認定之空間,但其見解是否合理,容有討論之必要。
