    Abstract: 所謂憲法變遷,係指在不更動憲法本文下,透過解釋,賦予憲法條文原所未有、但並未超越其文義之規範性內涵,以因應不同時代環境與條件的變化。制憲所形成之憲法規範性,有相當拘束力,卻必須面臨時間帶來之變化,如不願使憲法規範與現實呈現脫節,從國家學角度看來,憲法中止、憲法破棄、沉默修憲、憲法排除或憲法毀滅毋寧是遠離現行憲法的歧路,要因應來自於社會的變化,不採修憲,又欲維繫憲法條文與規範性指涉,憲法變遷應屬最重要與關鍵之方式。
