Abstract:	原告A，原任職於某在臺美商公司（下稱「美商○公司」。該公司實際上在臺僅設有辦事處，且未於我國申請認許或辦理分公司登記），其受僱職稱為「大中華區業務總監」，平均月薪為三十三萬九千八百元，工作地點包含臺灣、中國大陸及香港等地，工作內容主要負責大中華區兩岸三地等相關業務。該美商○公司並以投保單位依法為其在臺員工投保勞、健保，並向被告勞保局按月提繳「積欠工資墊償基金」。
