Abstract:	本文之目的在討論WTO法在國際法上的地位，以闡明了解WTO的法律體系到底是一個獨立發展自求完整的體系，還是傳統國際法的一部分？以及如果WTO法律體系是國際法的一部分，則其與其他的條約或是國際習慣法衝突時，何者優先適用？全文首先是介紹國際法的性質與淵源，藉由國際法的性質以解釋WTO法與國際法的關係；其次則是討論WTO法是否為一個自我完整的體系；在第三部分檢討說明WTO法與相關國際法規範衝突時當如何解決後，結論將簡述研究成果，說明WTO法律體系依舊是國際公法的一部分，與WTO法和其他國際法規則衝突時的解決之道。 This article aims at analyzing the status of WTO law in public international law. Following a brief introduction in Part I, part II examines the general relationship between public international law and WTO law. While part III discuss whether WTO law is a self-contented regime and, in certain respects, constitute lex specialis vis-à-vis certain rules of general international law, part IV deals with issues related to conflicts between WTO law and general public law. Some observations on the status of WTO law in public international law are included in final part.
