    Title: 自認與爭點整理程序中不爭執協議──評最高法院104年度台上字第207號民事判決

    Abstract: 按當事人對於他造主張之事實，或對於法官整理協議之不爭執事項，於言詞辯論或準備程序積極而明確的表示沒有意見， 性質上應屬民事訴訟法第279條第1項所規定之自認， 除依同條第三項規定撤銷外，在辯論主義之範圍內有拘束法院之效力，應以該自認之事實作為裁判之基礎。上訴人主張系爭房屋未辦理交屋、驗收之事實，分別經被上訴人於第一審94年4月21日言詞辯論， 及於原審101年4月26日準備程序表示「沒有意見」，有各該筆錄足憑，則被上訴人就上訴人主張系爭房屋未辦理交屋、驗收乙節，應已自認。乃原審竟以上訴人未有收回使用執照及門鎖之舉動，臆認兩造合意交付系爭房屋，已完成工程合約書第八條之驗收、交屋手續，進而為上訴人不利之論斷，亦有判決不適用法規之違誤。
