Title:	犯罪行為除外危險之解釋與最大善意原則--臺灣臺北地方法院一O一年度保險字第一一八號民事判決

Abstract:	原告侵入位於新北市淡水區之他人住宅並意圖性侵居住其內之女房客，惟被害人乘機逃脫向房東求救，原告眼見其犯行無法得逞，乃放棄其犯罪行為，至住宅後方陽台準備逃逸，然於逃逸時不慎自三樓陽台墜落於其下之竹林斜坡，致脊髓損傷合併下肢無力、胸部挫傷合併左側氣血胸，送至醫院急診就醫，於住院當日轉入加護病房，並於一○○年七月三十日接受頸椎第五六七節椎間盤切除及椎體融合固定手續，於一○○年八月三十日出院。原告受有上開傷害後，於一○一年一月三十一日經醫師鑑定為中度肢障並領有殘障手冊，一○一年九月五日經醫師檢查後認定四肢機能完全喪失，目前終日臥病在床，生活起居均仰賴他人協助處理；
