    Title: Extradition & the Death Penalty Dilemma: Legal Analysis of the Interaction of Extradition Laws and Contemporary International Law in United States v. Bin Laden

    Abstract: 本文從國際法觀點分析「美國對賓拉登」(United States v. Bin Laden)案,藉以闡明國家引渡法與國際法間產生之互動關係,指出在當代國際法中,引渡法、人權法及廢除死刑發展之新趨勢。當現行國際法尚未完全廢除死刑制度之際,國際人權法應優於國家引渡法。美國理應依照國際人權法廢除死刑之逐漸發展修訂其刑法,否則除非美國法庭保證不處以極刑,廢除死刑之國家因恐「喀爾費斯比主義」(the Ker-Frisbie Doctrine)將與其本國法相抵觸,而拒絕引渡死刑犯至美國。
