    摘要: 我國法並未採納房屋及土地所有權合一的設計,致有時出現房、地所有權分離的現象,成為實務上頗為棘手的問題。民法雖於88年間增訂第425條之1規定,但對於土地及其上之房屋非屬一人所有,而僅土地或僅房屋所有權讓與他人,究應如何規制基地利用關係,土地所有權人得否訴請拆屋還地,相關爭議涉及債權、物權概念對立,土地、房屋權利衝突的規範等問題,頗為錯綜複雜,實務上所適用法律見解迭有爭議。為解決相關爭議,最高法院曾作成95年度第16次民事庭會議決議,但因這項決議並未就相關疑義提供統一而明確解決方案,反而以訴諸帝王條款─誠信原則的方式作為個案裁判的指導規範,形成日後多起案例均因涉及誠信原則的論證而耗費大量訴訟資源,包括因是否違反誠信原則而待調查事實不明,致一再遭最高法院廢棄發回,訴訟程序處於高度不確定狀態。本計畫乃針對此種法律適用上高度不確定狀態,試圖以該決議為探討基礎,檢驗所生影響及其妥當性,據以嘗試尋求新的解決建議,使法律的適用不僅發揮規範目的之功能,同時也導出符合個案正義的妥適結論,以兼顧形式推論及實質妥當性。
    According to the Civil Code the owner of the housing and its base could be not the same one. The separation of the ownership between the housing and land has induced a series of problems which perplex the parties and the court involved for some years. The key issues focus not only on the antithetic conception of claim and property but also on the relation between housing and its land-use right. Although the Supreme Court had provided some suggestions- based on the argument of so called imperial principle of good faith- by its intern conference, such kind of disputes remain unsolved due to the complexity of the issues. It is argued that the above mentioned suggestions would result in consuming lots of judicial resources and excess cost in litigation. Under these circumstances the proceedings would be not only intricate but also unstable as well. In this context this research project is trying to explore the basis for the new resolution. It is highly expected that it could contribute to make an acceptable balance between the stable application of the law and the appropriate result in the concrete cases.
