    摘要: 本計畫擬以立法院去年11月通過勞動基準法修正所對於最低服務年限約定與離職後競業禁止條款予以明確之規範為契機,意圖以「判決分析法」為研究方法而觀察台灣最低服務年限約定與離職後競業禁止條款之司法審查傾向並對其立法化進行檢討。 亦即,擬透過全面性地整理、分析司法機關實務目前之見解,進行具體系性之論述,而對最低服務年限約定與離職後競業禁止條款之正確運作提供一學術界所能供予之兼具理論與實務、知識與現實需求之理想基礎。其結果,將不只豐富往後勞動法學之研究成果,並且得作為將來我國實務運作之參考,藉以提高法院判決之水準而有助於勞動司法裁判之穩定性與正確性之建立。 此外,透過與中國法制的比較研究而找到台灣法制可能的問題點及其解決途徑,並作為將來擬定兩岸勞動政策及修法之參考。
    The Legislative Yuan amended the Labor Standards Act in November 2015. In this amendment, provisions of minimum years and post-employment covenants not to compete has been expressly provided. By referee method of analysis and in-depth interviewing, this research program will observe the tendency of the judicial review of Taiwan to provisions of minimum years and post-employment covenants not to compete. And it will do the discussion on this amendment. By completely collating and analyzing the recent views of the judiciary, and proceeding to discuss orderly, the ambition of this project is to provide the basiswhich is logical, practical, for the practice of the provisions of minimum years and post-employment covenants not to compete. As a result, this research will not only enrich the Labor Law, and was used as a reference for future operations of our practice, in order to improve the standard of the court`s rulings and decisions and contribute to the stability of the ruling Labor and the correctness of the administration of justice set up. Besides, by means of compare research methods, I wish I can find the defect and its solution to improve the Taiwanese legal system, for the purposes of drafting the labor policy and amending the law in Taiwan-China both coasts as well, in the future.
