    Title: 美國憲法上宗教自由、同性婚姻，與反歧視法之衝突
    The Tension among Religious Freedom, Same-Sex Marriage and Antidiscrimination Law: in Light of American Constitutional Law

    Abstract: 本計畫結論： (1) 憲法上的宗教信仰自由，並非限制同性婚姻成為憲法權利之正當理由。 (2) 基於宗教信仰所為之行為，應可適度豁免於一般性法律（包括「禁止性傾向歧視」的 反歧視法）的規範。但在美國目前判例下，會有困難。 (3) 若同性婚姻為憲法所保障之權利，因宗教信仰而反對同性婚姻之人，得主張信仰自由，而在日常交易中，拒絕提供同性婚姻當事人某些服務？但目前美國往往必須透過「表現自由」而非僅依「宗教自由」來保障其信仰。
    This project concludes that: (1) The constitutional guarantee of religious freedom can`t be the legitimate ground to oppose same-sex marriage. (2) An action based upon sincere religious faith must be exempted from generally application law (e.g. antidiscrimination law forbidding sexual orientation discrimination), but this constitutional claims must overcome the U.S. Supreme Court`s Smith precedent. (3) In case that same-sex marriage were deemed a constitutional right, citizens opposing same-sex marriage out of religious faith are entitled to refuse to provide service or to decline engaging in transactions with gays/ lesbians. In practice, Freedom of Expression seems more useful in constitutional lawsuit as such.
