    Abstract: 1814年Savigny與Thibaut就德意志地區是否須要以法國民法典為本;進行法典化的工作來克服德意志法律碎裂化的工作;進行了一場有意義的爭論。其後;Savigny的主張獲得勝利;但其也要提出解決德意志地區法律碎裂問題的方法;故其建立了歷史法學派;也就是要將法的歷史素材予以邏輯的體系化;當建立了這樣的法體系之後;法律的碎裂化問題就可以得到克服;而真正在方法上完成這樣工作的是Savigny的學生Puchta所提出的概念法學;透過概念法學的方法;德意志地區建構了所謂的學說編撰法學;而正是有學說編撰法學做基礎;德國民法典始得於1896年通過;1900年1月1日施行。但在19世紀末期;概念法學受到越來越多的批評;一個是Jhering的方法論上批評;另一個則是Gierke和Menke在意識型態上的批評;而這兩種批評在20世紀繼續延續下來;成為對德國民法典的批評。故而可以這麼說;瞭解概念法學的成立緣由、歷史背景、主要命題、法律觀以及相關的批評;也就是貴族法律觀與平民法律觀之間的鬥爭;就掌握了瞭解德國19世紀民法學發展的鑰匙。
