Abstract:	本文討論刑法的行為概念，首先分析現有各類行為理論的良窳，討論其解釋適用時的問題與對應之道，接著再從古典哲學、神經科學及心靈哲學等三重面向，分析人、行為及損害的關係，從而建構刑法的行為概念。初步看法認為：一、行為有獨立於構成要件的必要性；二、行為概念僅指涉人與身體行止的關係，不涉及損害後果；三、人與身體行止包括「生理傳導關係」及「他行動可能性」等兩個要素，這兩個要素共同構築了刑法的行為概念。
