    Abstract: 本文透過具體案例，討論強盜預備罪的三個問題，(1)預備犯能否成　立共同責任？(2)強盜預備罪的主觀及客觀構成要件內容為何？(3)預備行為實施後、著手實行犯罪前若放棄續行犯罪應如何評價？筆者將於本文中實質回答三個問題，並提出個人見解。
