Abstract:	本文討論挑唆防衛的成立要件與法律效果，挑唆防衛一般可分為意圖式及非意圖式兩類，本文認為通說迄今對兩類挑唆防衛建立的處理標準均有研議空間。依本文之見，正當防衛與法秩序的保護無關，純粹為受不法侵害的防衛者法益保護需求，但若防衛者對不法侵害的發生有意圖式的參與效果時，其防衛權能應受限制，此即意圖式挑唆防衛；相對於此，非意圖式挑唆防衛則不應限制防衛者的反擊權能。
