    區分所有權人占用自己專有之騎樓,縱然使用不符法律規定,難認為無權占有。況該騎樓之使用利益歸屬占有人,其他區分所有權人未受「權益侵害」而無「損害」,故不具備不當得利要件。無權占有法定空地,係逾越應有部分之範圍使用收益共有物,侵害應歸屬於他共有人的權益內容,縱被占用之法定空地不得出租或供建築使用,仍成立侵害權益之不當得利。蓋不具保有利益之正當性,即當然「致他人受損害」,乃侵害型不當得利之特徵。
