    Abstract: 目前我國實務上關於受僱人未服勞務而欲請求報酬之相關判決中,絕大部分為請求確認僱傭關係存在或主張僱用人終止僱傭契約不合法的事件,一旦法院認定僱傭關係繼續存在,受僱人即可主張民法第 487 條之報酬請求權。則僱用人何時陷於受領遲延,因涉及受僱人報酬請求權發生之時點,影響到受僱人得請求報酬之期間長短,即為值得探究課題。本文擬針對法院認定僱用人終止僱傭契約無效時,僱用人何時陷於受領遲延之判斷進行分析整理,並藉此釐清目前關於僱用人受領遲延之要件,實務見解所採之立場。
