Abstract:	在侵權行為的情形，被害人之特殊體質造成之損害，並非影響認定加害人之注意義務的違反或相當因果關係的因素，從而加害人應賠償其因此造成之損害應無異論。但被害人之特殊體質影響侵權行為所致損害之發生或擴大時，加害人得否以被害人之特殊體質主張與有過失以減（免）額，即為本設例之爭點所在。
