    Title: 德國建設法中都市更新衡平費之徵收及相關問題之研究

    Abstract: 德國建設法(BauGB)中城市更新係在都市計畫的脈絡下所為之規範,強調地方自治團體應依其自治權限確定應實施更新之區域,訂定更新自治規章,確立更新之目的及原則,以指導後續更新程序中採取之相關措施。即使地方自治團體基於公私協力的考量,委託企業
    協助準備或實施更新程序,亦注意利益衝突及迴避原則,建設法明文禁止建設公司擔任更新實施者,亦禁止更新實施者同時以自己利益實施更新程序並同時擬訂建設指導計畫,而產生有圖利自身的可能。此外,當土地因更新而增值時,德國建設法更明文規定土地所有權人應負擔更新衡平費。除了填補更新所需之財務外,更突顯土地漲價歸公之公平正義理念。反觀我國都市更新之法制及實務,不僅實務上因為都市更新計畫之缺乏,導致都市更新之實施欠缺重要的指導目標及原則,對於都更實施者的資格亦未有限制,往往形成都市更新的公共利益由建設公司掌控的亂象。再者,我國都更條例強調對於都市更新的獎助,訂有容積獎勵、容積移轉及減免稅捐相關規定,卻未重視土地所有權人因都市更新土地增值所獲得的暴利應予衡平的機制。凡此種種法制之缺失,皆成為近年來民間辦理都市更新造成土地不正義之亂源。重視我國都更條例法制上不符都市計畫及公平正義本質的問題,進行根本的修法調整,實為現行當務之急。
    In the German BauGB the stipulations of the urban renewal follow the thoughts of the construction leading design. The municipality adopts a statute for the urban renewal and states the city-redeveloping area on account of its planning Highness formally. In the statute the aim and the
    purposes of the urban renewal will be determined and lead the renewal measures in the following renewal procedures. If the municipality delegates an enterprise to prepare or to execute the renewal procedure, it must also pay attention to the conflicts of interests. In the BauGB it is prescribed that the delegated enterprise may not be a building contractor and the enterprise not as representatives of the municipality for own bill and at the same moment construct the leading plan. Besides, it is also
    determined that the estate owner has to pay an equity fee in money to the municipality to give a share on the one hand in the expenses of the urban renewal and to correspond, on the other hand, to the justice, because the price of the estate increases because of the urban renewal. The appropriate legal institutions lack in the judicial system in Taiwan and it leads to the injustice and disorder by the city development. We must pay attention to these legal problems and improve the urban renewal law of Taiwan.
