    Abstract: 經濟憲法在公經濟法體系內涵中,居於經濟政策與經濟干涉行為形塑之最高指導規範地位。我國憲法典中,從工作權與財產權等自由權,到中央與地方權限劃分,乃至於基本國策國民經濟專節等,皆存有涉及經濟基本秩序形成之相關規範。此外,憲法基本原則中之民主國原則、法治國原則與社會國原則,對於國家之經濟干涉行為,亦扮演重要之制約與引導角色。透過經濟憲法概念之提出與內涵之理解,不僅可使吾人對於憲法中涉及經濟重要關聯性之規定,能有一體系性之整體認知,更得以進一步將其與經濟部門之現實相結合,作規範與現實之詮釋循環,以降低二者間嚴重脫節之憲法釋義學上風險。
