    Title: 僱用人受領遲延之法律效果

    Abstract: 家事服務員乙受僱於甲,甲、乙約定僱傭期間為3年,工作時間為每周一到周五,早上9點至下午5點;月薪新臺幣3萬元,而每月末日甲應以現金支付當月之報酬。工作內容則為乙應服從甲具體之指示,至甲家中從事打掃、洗衣,及煮飯等勞務。乙工作滿1年後,某日甲無來由地通知乙,「明天開始不用來了!」。乙錯愕之餘,當場立刻向甲抗議,「說好工作3年的,現在才過了1年,你不能隨便開除我!」;然而在甲的堅持之下,乙只好悻悻然地回家。事後乙起訴請求確認甲、乙間僱傭關係存在,並獲勝訴判決確定;乙遂依民法第487條,請求甲給付乙被開除之日起至乙復職日止之報酬。甲則以乙被開除後,乙從未通知甲受領其勞務,而以乙未提出勞務之給付為由,拒絕給予報酬。試問:甲、乙之主張何者有理由?
