Title:	專利複合之專利權價值分攤與損害賠償－以智慧財產法院101年度民專上字第4號判決為例

Abstract:	本案雖從事實方面觀察，僅是「附隨銷售」的專利侵權類型，主要的爭議在損害賠償範圍之決定，究竟是要以侵權物（「胎緣固定裝置」）為計算基準，抑或適用完全市場價值法則之法理，以附有胎緣固定裝置的輪胎為中心，計算損害賠償。本文已就完全市場價值法則於專利損害賠償法制下的真正意義，與本案的適用，作一檢討與解析。本文亦對「內納銷售」侵權類型所涉及專利複合的現象，以及損害賠償計算的專利價值分配問題，提出粗淺的觀察與探討。
